Creation Shop – Liability Waiver & Photo Release

This agreement applies to all participants in classes, workshops, open studio sessions, events, and activities hosted by Creation Shop, located in Fergus Falls, Minnesota.

ADULT PARTICIPANTS (18+)

By registering for or participating in activities at Creation Shop, I acknowledge and agree to the following:

Assumption of Risk

I understand that pottery, ceramics, sculpture, and art-related activities involve inherent risks, including but not limited to cuts, burns, strains, exposure to dust, sharp tools, kilns, equipment, and accidental injury. I understand that these risks may occur even when proper care, instruction, and supervision are provided. I voluntarily choose to participate and assume all risks, known and unknown, associated with these activities and the premises.

Release of Liability

To the fullest extent permitted under Minnesota law, I release and hold harmless Creation Shop, its owners, employees, instructors, volunteers, and affiliates from any and all claims, demands, actions, or causes of action arising out of or related to my participation or presence on the premises, including injury, illness, loss, or damage to personal property, whether caused by negligence or otherwise.

Medical Responsibility

I certify that I am physically capable of participating in these activities and agree to take responsibility for my own medical care in the event of injury.

Photo & Media Release

I grant permission for photographs or video taken during classes or events to be used by Creation Shop for promotional, educational, or archival purposes, including on websites and social media, without compensation.

MINOR PARTICIPANTS (UNDER 18) – PARENT / GUARDIAN CONSENT

This section applies when a parent or legal guardian registers a minor for participation.

Assumption of Risk

I understand that pottery, ceramics, sculpture, and art-related activities involve inherent risks, including but not limited to cuts, burns, exposure to dust, sharp tools, kilns, and equipment. I voluntarily allow the minor to participate and assume all risks, known and unknown, on their behalf, including risks associated with the premises.

Release of Liability

To the fullest extent permitted under Minnesota law, I release and hold harmless Creation Shop, its owners, employees, instructors, volunteers, and affiliates from any and all claims arising from the minor’s participation or presence on the premises, including injury, illness, or property damage, whether caused by negligence or otherwise.

Medical Consent

In the event of an emergency, I authorize Creation Shop staff to seek medical treatment for the minor if I cannot be reached. I agree to be financially responsible for any medical care required.

Photo & Media Release

I grant permission for photographs or video of the minor taken during classes or events to be used by Creation Shop for promotional, educational, or archival purposes, without compensation.

Parental Acknowledgment

I certify that I am the parent or legal guardian of the minor participant, have read this waiver fully, understand its terms, and consent voluntarily on behalf of the minor.

GENERAL TERMS (ALL PARTICIPANTS)

• Creation Shop reserves the right to refuse or discontinue participation for unsafe or disruptive behavior.

• This waiver applies to all current and future participation unless revoked in writing.

• If any portion of this agreement is found to be unenforceable, the remaining portions shall remain in full force and effect.

• This agreement shall be governed by the laws of the State of Minnesota.
